Agreed Order Signed with Emmitt Lewis, Jr.

October 25, 2011

On May 5, 2011, an Emergency Cease and Desist Order was issued to Emmitt Lewis, Jr., dba Lewis Funeral Home and Chapel, Brenham, Texas, for the sale of a trust-funded preneed funeral contract without the required state permit and the mishandling of funds as required by Texas Finance Code Chapter 154.

On September 12, 2011, Mr. Lewis entered into an agreement with the Department to cease any unlicensed activity and pay a $2,000 administrative penalty. Mr. Lewis certified that all outstanding illegal contracts were voided, related funds returned to the purchasers, and any future contracts would not be sold unless the proper permit is obtained.
